Who the F-Gas Operator Is

The F-gas operator is the person with real control of the equipment, not automatically the installer or the landlord. How UK shops and landlords should name them.

The F-gas operator is the natural or legal person with actual power over the technical functioning of the equipment. In plain English, it is whoever can decide that the system runs, is serviced, is repaired or is switched off. That is often the owner, and in a let shop it may be the tenant, depending on the lease and on who really instructs the engineer. The installer is the certified contractor who does the work. They do not automatically remain the operator after they leave site. Read the current GOV.UK wording, then match it to the contract in your building.

The tenant who approves every repair

Picture a let shop where the tenant chooses the maintenance firm, approves repairs and sets the controls, while the landlord still owns the cassette on the wall. Operator status follows that control. If you do those things, you are very likely the operator. If the landlord's agent does all of that and you only dust the fascia, the landlord may be the operator.

Shared control, with a service charge and a tenant override, is where arguments start. Write it down. GOV.UK's certification guidance is aimed at companies who work on the gas. The operator's duty sits beside that: use those certified companies, keep records, arrange leak checks when the carbon-dioxide equivalent says you must, and see that refrigerant is recovered rather than vented. The installing company is not the operator by default. They are the certified contractor. A maintenance contract can spell out tasks. It does not silently move operator status unless control really moves.

Service charges and a landlord plant

A full repairing and insuring lease often pushes plant responsibility to the tenant. An internal-only demise, or a landlord system serving several units, often leaves the landlord or the agent as the operator of the central plant, while the tenant might still control a small split in the demise.

  • Operator: actual control of how the equipment functions.
  • Installer: certified contractor, not automatically the operator.
  • The service charge might pay the invoice without moving the legal duty.
  • Ask the agent which plant you may instruct an engineer to open.

Logs that should move when the lease ends

Records of refrigerant added or removed, leak checks where they apply, and which certified company attended stay with the operator even if the contractor keeps a copy. When you sell the business or hand back the lease, the log is part of the handover. A missing log is a poor surprise for the next operator. If a leak is found, the operator arranges a certified repair. Nothing here describes how to find or mend a leak. Venting to atmosphere is an offence. End-of-life recovery is arranged by the operator and carried out by certified people. Air conditioning inspections under the GOV.UK inspection guidance are another duty, triggered by rated output. The person who must arrange that inspection may sit in the same chair as the F-gas operator, or the lease may name someone else. Do not assume one phrase covers both. Naming an operator does not remove leak-check duties. It identifies who must meet them. Whether checks are due still depends on the carbon-dioxide equivalent of the charge.

Stop the season if nobody will sign the operator line

On the next service sheet, add one line: who is the F-gas operator for this system. If the contractor cannot answer, the landlord and tenant should agree before the cooling season, with the lease and the current GOV.UK definition in front of them. Where the wording is unclear, a solicitor is the right reader of the lease. This page is not that advice. Tell your maintenance company the answer so they know who may authorise work that opens the circuit. Certified competence is their obligation. Clear instruction is yours.
